Pengembangan Insan PHE Subholding Upstream yang UnggulDevelopment of Excellent PHE Subholding Upstream Personnel 10 11Penghormatan terhadap hak asasi manusia (HAM) merupakan prinsip yang mendasar dan tidak dapat dikompromikan dalam konteks manapun, termasuk dalam lingkungan kerja. PHE Subholding Upstream mengedepankan penghormatan pada HAM, hal ini bukan hanya tentang mematuhi hukum dan regulasi yang berlaku, tetapi juga tentang menciptakan lingkungan kerja yang adil, aman, dan menghormati martabat setiap individu. Dengan mendorong penghormatan terhadap HAM di tempat kerja, Perusahaan tidak hanya menciptakan lingkungan yang lebih baik untuk pekerja, tetapi juga menghasilkan dampak positif pada produktivitas, kinerja, dan pencapaian target perusahaan secara keseluruhan.PHE Subholding Upstream telah menerbitkan Kebijakan Untuk Menjamin Hak Asasi Manusia Dalam Bisnis Pertamina Hulu Energi pada Oktober 2022. Kebijakan ini merujuk pada UndangUndang No. 39 Tahun 1999 tentang Hak Asasi Manusia, Deklarasi Universal Hak Asasi Manusia Tahun 1948 dari Perserikatan BangsaBangsa, serta Prinsip-prinsip Hak-hak Mendasar di Tempat Kerja berdasarkan 8 Konvensi Inti International Labour Organization (ILO) yang juga telah diratifikasi oleh Pemerintah Indonesia. Kebijakan ini berisikan tentang sarana untuk penyampaian keluhan terkait pelanggaran HAM, uji tuntas HAM secara berkelanjutan dalam kegiatan bisnis Perusahaan, budaya menghormati HAM di antara Perwira PHE Subholding Upstream, menjamin hak pekerja, serta menghormati HAM masyarakat adat.PHE Subholding Upstream menyediakan akses pelaporan untuk segala bentuk diskriminasi, kekerasan, dan pelecehan yang terjadi di tempat kerja, baik melalui whistleblowing system dan mekanisme pelaporan grievance yang diatur dalam peraturan Perusahaan. Pada tahun 2023, Perusahaan tidak menerima laporan adanya insiden diskriminasi terhadap pekerja dan/atau diskriminasi dalam bekerja.[GRI 406-1] Sejalan dengan dukungan pada nilai-nilai universal HAM, PHE Subholding Upstream memiliki keberpihakan yang tinggi terhadap penduduk asli/masyarakat adat di sekitar wilayah operasi. Perusahaan menjunjung tinggi hak-hak masyarakat adat seperti hak atas tanah, hak sosial ekonomi dan budaya, serta hak partisipasi efektif masyarakat adat. Perusahaan melibatkan masyarakat lokal dan menghargai hak kolektif masyarakat untuk mengambil sikap setuju atau tidak setuju terhadap rencana pengembangan program yang diusulkan pada wilayah mereka, sejalan dengan prinsip Free, Prior, and Informed Consent (FPIC). PHE Subholding Upstream telah memasukkan prinsip FPIC ini dalam Pedoman Pengelolaan Tanggung Jawab Sosial dan Lingkungan (TJSL) No.A13-003/PHE01000/2021-S9. Kegiatan usaha PHE Subholding Respect for human rights is a fundamental principle and it cannot be compromised in any context, including in the work environment. PHE Subholding Upstream prioritizes respect for human rights; it does not merely revolve around complying with applicable laws and regulations, but also creating a work environment that is fair, safe, and respects the dignity of every individual. By encouraging respect for human rights in the workplace, the Company not only creates a better environment for employees, but also generates a positive impact on productivity, performance, and achievement of overall company targets.PHE Subholding Upstream has issued a Policy to Guarantee Human Rights in Pertamina Upstream Energy Business in October 2022. This policy refers to Law No. 39 of 1999 on Human Rights, the 1948 Universal Declaration of Human Rights of the United Nations, and the Principles of Fundamental Rights at Work based on 8 Core Conventions of the International Labour Organization (ILO) which have also been ratified by the Government of Indonesia. This policy contains a means for submitting complaints related to human rights violations, ongoing human rights due diligence in the Company's business activities, a culture of respecting human rights among PHE Subholding Upstream Officers, guaranteeing employees' rights, and respecting the human rights of Indigenous peoples.PHE Subholding Upstream provides access to reporting of all forms of discrimination, violence, and harassment that occur in the workplace, both through a whistleblowing system as well as grievance reporting mechanism provided for in the Company Regulation. In 2023, the Company received no reports of incidents of discrimination against employees and/or discrimination in the course of employment. [GRI 406-1]In line with support for universal human rights values, PHE Subholding Upstream has had a high level of alignment toward indigenous peoples around the operational area. The Company upholds the rights of indegenous peoples such as land rights, socio-economic and cultural rights, as well as the right of effective participation of indegenous peoples. The Company engages local communities and respects the collective right of communities to agree or disagree with proposed program development plans in their areas, in line with the principles of Free, Prior, and Informed Consent (FPIC). PHE Subholding Upstream has included such FPIC principles in the Social and Environmental Responsibility Management Guidelines (TJSL) No.A13-003/PHE01000/2021-S9.
