PadaDesember 2020, Kontraktor sebelumnyamengajukan gugatan pelanggarankontraktual terhadap PHSS di SingaporeInternational Arbitration Center (SIAC)(%u201cPihak Yang Mengajukan Klaim%u201d). Klaimadalah terkait dengan pengembalian biayainvestasi dalam konteks kegiatan usaha hulu minyak dan gas bumi. Nilai gugatan adalahsebesar AS$111 Juta. Per Juni 2022:PHSS became the operator of the SangaSanga block in August 2018. In December 2020, the previous operator filed a breach of contract claim against PHSS in the Singapore International Arbitration Centre (SIAC) (%u201cClaimant%u201d). The claim relates to the recovery of investment costs in the context of upstream oil and gas business activity. The amount of the claim is approximately US$111 million. Per June 2022:i. Pihak Yang Mengajukan Klaimmengajukan usulan penyelesaianperkara dengan menandatangani suatuSettlement Agreement yang padaakhirnya akan dituangkan dalam suatuConsent Award dari Majelis ArbitorSIAC atas usulan ini PHSS setuju;i. The Claimant propose to settle the case byhaving the settlement agreement whicheventually will be endorsed under ConsentAward of SIAC%u2019s tribunal, PHSS agree withthis proposal;ii. Settlement Agreement sudah ditandatangani oleh semua pihak dan pada tanggal 29 Juni 2022 Consent Award telah terbit.ii. The Settlement agreement has beensigned by all the parties and on June 29,2022 the Consent Award issuance hasbeen issued.Dengan terbitnya Consent Award, maka telah final dan binding sehingga perkara dimaksud telah selesai.With the issuance of the Consent Award, Thus it is final and binding and therefore this case has been completed.iv. Pelaksanaan Putusan Arbitrase International Court of ArbitrationInternational Chamber of Commerce (ICC) No. 24866/AYZ/ELU bertanggal 2 November 2022iv. The Execution Arbitration Award ofInternational Court of ArbitrationInternational Chamber of Commerce (ICC)No.24866/AYZ/ELU dated 2 November 2022National Oil Company Libya (%u201cNOC%u201d) sebagai penggugat telah menggugat/mengajukan permohonan arbitrase di International Chamber of Commerce (%u201cICC%u201d) terhadapPertamina E&P Libya Ltd (%u201cPEPL%u201d) dan PT Pertamina (Persero) (%u201cPertamina%u201d) selaku Responden, atas 2 (dua) Exploration and Production Sharing Agreement (%u201cEPSA%u201d) tertanggal efektif tanggal 10 Desember 2005di Wilayah Kerja 17-3 dan 123-3. Pertamina digugat dalam kapasitasnya selaku Guarantor atas kewajiban PEPL berdasarkanmasing-masing EPSA. NOC mengklaim PEPL memiliki kewajiban pembayaran sejumlah penalti kontraktual sebagai akibat tidak dilaksanakannya sisa minimum exploration commitment berupa exploration program selama masa eksplorasi berdasarkan masing-masing EPSA.National Oil Company Libya (%u201cNOC%u201d) as the Claimant has submitted claim/request for arbitration at the International Chamber of Commerce (%u201cICC%u201d) against Pertamina E&P Libya Ltd (%u201cPEPL%u201d) and PT Pertamina (Persero) (%u201cPertamina%u201d) as the Respondents, regarding the (two) Exploration and Production Sharing Agreement (%u201cEPSA%u201d) which have effective date 10 December 2005 for 17-3 and 123-3 Working Area. Pertamina is bound in regard with its capacity as Guarantor for PEPL's obligations in each EPSA. NOC claims that PEPL has obligation to pay a contractual penalties as a result of not carrying out the remaining minimum exploration commitment in the form of the exploration program during the exploration period according to EPSA%u2019s.
