Struktur dan Kedudukan Fungsi Legal CounselStruktur organisasi fungsi Legal Counsel ditetapkan sesuai Surat Keputusan Direksi No. 052/PHE00000/2022-S0 tanggal 15 Juli 2022. Berikut disampaikan struktur dan kedudukan fungsi Legal Counsel yang menggambarkan peran dan fungsi serta koordinasi dalam keorganisasian PHE.Structure and Position of Legal Counsel FunctionThe organizational structure of the Legal Counsel function is stipulated in accordance with Resolution of Board of Directors No. 052/PHE00000/2022-S0 dated July 15, 2022. The following is the structure and position of the Legal Counsel function which illustrates the roles, functions, and coordination within the organizational structure of PHE.Hingga akhir tahun 2024, jumlah pekerja yang tergabung dalam Fungsi Legal Counsel sebanyak 25 (dua puluh lima) pekerja dengan status PWTT, 9 (sembilan) pekerja dengan status PWT, dan 5 (lima) pekerja dengan status TKJP dengan total keseluruhan pekerja adalah 39 (tiga puluh sembilan) pekerja. Tugas dan Tanggung Jawab Fungsi Legal CounselMenganalisa dan melaksanakan kegiatan pemberian layanan hukum baik PHE yang meliputi area Business Development, Litigation, Operations, Partnership (kemitraan), Pengadaan Barang dan Jasa, Komersialisasi Minyak dan Gas Bumi, Corporate Matters, Advocacy, pengembangan SDM Fungsi Legal, dan pemberian saran/layanan hukum terkait aspek hukum dari kegiatan-kegiatan pendukung usaha PHE lainnya. Kegiatan pemberian layanan hukum tersebut meliputi pemberian legal opini dan legal advice, penanganan kontrak rutin dan non-rutin, penanganan dokumen perusahaan, penanganan sengketa (litigasi dan non-litigasi), memberikan layanan advokasi terhadap peraturan perundang-undangan, identifikasi dan perumusan aspek-aspek hukum, pemberian pertimbangan hukum, pemberian nasihat hukum, penanganan perkara litigasi, penyelesaian perselisihan non-litigasi atau dalam bentuk alternatif penyelesaian sengketa lainnya dan pelaksanaan kegiatan advokasi sehubungan dengan adanya proses hukum yang melibatkan Perusahaan dan Pekerja dalam pelaksanaan kegiatan Perusahaan. Until the end of 2024, the number of workers in the Legal Counsel Function is 25 (twenty-five) workers with PWTT status, 9 (nine) workers with PWT status, and 5 (five) workers with TKJP status, with a total of 39 (thirty-nine) workers. Duties and Responsibilities of Legal Counsel FunctionAnalyze and provide legal services for PHE covering the areas of Business Development, Litigation, Operations, Partnership, Procurement of Goods and Services, Commercialization of Oil and Gas, Corporate Matters, Advocacy, development of Human Resources for the Legal Function, and provision of legal advice/services related to legal aspects of other PHE business support activities. The legal service provision activities include providing legal opinions and legal advice, handling routine and non-routine contracts, handling company documents, handling disputes (litigation and non-litigation), providing advocacy services for laws and regulations, identification and formulation of legal aspects, providing legal considerations, providing legal advice, handling litigation cases, non-litigation dispute resolution or in other alternative forms of dispute resolution and implementing advocacy activities in connection with legal processes involving the Company and Employees in the implementation of activities of the Company.
