The Utilization Tariff of Badak LNG Plant forWestern Buyers (%u201cWBX%u201d) and Nusantara Regas(%u201cNR%u201d) Sales ContractsMenteri Keuangan melalui Direktorat JenderalKekayaan Negara, dalam suratNo. S-355/MK.6/2017 tanggal 29 Desember2017 tentang Persetujuan Pemanfaatan BarangMilik Negara Berupa Aktiva Kilang LNG Badakuntuk Gas Bumi dari Wilayah Kerja MahakamPasca-2017, memberikan persetujuan kepadaPHM untuk memanfaatkan kilang LNG Badakuntuk pemrosesan gas dari wilayah kerjaMahakam dengan membayar tarif pemanfaatansebesar AS$0,22/MMBTU, diluar biaya operasidan pemeliharaan serta pengeluaran kapital(%u201cSurat S-355/2017%u201d).The Minister of Finance (%u201cMoF%u201d) through theDirectorate General of State Assets, in its letterNo. S-355/MK.6/2017 dated December 29, 2017regarding the Approval of the Utilization of Stateowned Assets of Badak LNG Plant for the Gas fromMahakam Working Area Post-2017, has grantedapproval to PHM for utilizing the Badak LNG plant toprocess the gas from the Mahakam working area bypaying a utilization tariff of US$0.22/MMBTU,excluding operating and maintenance cost andcapital expenditures (%u201cLetter S-355/2017%u201d).Namun, Surat S-355/2017 tersebut tidaksejalan dengan persetujuan Menteri Keuangansebelumnya dalam surat No. S-651/MK.6/2011tentang Pemanfaatan dan Optimalisasi AsetKilang LNG Badak untuk Gas WK Mahakamtanggal 20 Oktober 2011 kepada DirekturUtama PT Pertamina (Persero) (%u201cSurat S651/2011%u201d), yang butir 3.a dalam surat tersebutmenyatakan bahwa Menteri Keuanganmenyetujui pemanfaatan aset tanpapembebanan sewa terhadap kontraktor KBHyang masih terikat kontrak penjualan LNG(VICO, Total EP, dan Chevron), mengingatkontrak penjualan gas telah ditandatangani olehPemerintah dan produsen gas di masa lalu.However, Letter S-355/2017 is not in-line with theprevious approval from the MoF under its letterNo. S-651/MK.6/2011 regarding Utilization andOptimization of Badak LNG Plant Asset forMahakam working area gas dated October 20, 2011addressed to the President Director of PT Pertamina(Persero) (\such letter stated that the MoF agrees that rentalcharges shall not be applied to the PSC contractors,who are still bound by LNG sales contracts (VICO,Total EP, and Chevron), considering that the LNGsales contracts have been signed by theGovernment and the gas producers in the past.Pengecualian dalam Surat S-651/2011 tersebutdiberikan kepada kontraktor KBH yang kontrakpenjualannya telah ditandatangani sebelumdikeluarkannya Surat S-651/2011 (termasukkontrak penjualan WBX dan NR). Pada saatsurat tersebut dikeluarkan, Pemerintah belummenetapkan kontraktor wilayah kerja Mahakampasca-2017. Dengan mempertimbangkanpenetapan kontrak wilayah kerja Mahakam saatini yang berlaku efektif sejak 1 Januari 2018,maka PHM berpendapat bahwa PHM jugaberhak mendapatkan pembebasan tarifpemanfaatan karena melanjutkan suplai LNGuntuk kontrak penjualan WBX (hingga tahun2020) dan NR (hingga tahun 2022).The exemption as stated in the Letter S-651/2011was granted to the PSC contractors who have salescontracts signed prior to the issuance ofLetter S-651/2011 (including WBX & NR salescontracts). At the issuance of such letter, theGovernment had not decided the contractor ofMahakam working area post-2017. Considering theeffective date of the current Mahakam PSC fromJanuary 1, 2018, PHM is of the opinion that PHM isalso entitled to the exemption of the utilization tariffsPHM continues with the LNG supply contracts forWBX (until 2020) and NR (until 2022).Oleh karena itu, sejak dikeluarkannya SuratS-355/2017 tersebut, PHM, denganpersetujuan SKK Migas, meminta pengecualiantarif pemanfaatan kilang LNG Badak kepadaMenteri Keuangan untuk kontrak penjualanWBX dan NR dengan pertimbangan sebagaiberikut:As such, subsequent to the issuance of the LetterS-355/2017, PHM, with approval of SKK Migas,requested an exemption of the Badak LNG plantutilization tariff from the MoF for WBX and NR salescontracts based on the following considerations:
