Dengan kondisitersebut, Cooper tetap menjalankangugatannya dengan meminta pengadilannegeri setempat di Victoria, Australiauntuk memproses gugatan Cooper tanpakehadiran PHE (default judgement).In 2022, Cooper has taken legal action/lawsuitthrough the local district court in Victoria, Australia,but as of the end of March 2024, this legalaction/lawsuit has not been accepted by PHE inaccordance with the rogatory process based on therules in force in Indonesia. Under these conditions,Cooper continued to carry out his lawsuit by askingthe local district court in Victoria, Australia to processCooper's lawsuit without the presence of PHE(default judgement).Selanjutnya, PHE menanggapi prosesgugatan tersebut melalui pernyataankehadiran sidang dengan syarat(Conditional Appearance) agarpengadilan negeri di Victoria juga dapatmengadili terkait proses rogatory yangbelum dipenuhi.Furthermore, PHE responded to the lawsuit processthrough a statement of court attendance withconditions (Conditional Appearance) so that thedistrict court in Victoria could also adjudicate relatedrogatory processes that had not been fulfilled.Posisi PHE tersebut mengacu pada hasilkonsultasi dan koordinasi denganexternal counsel Allen & Overy,Jamdatun, dan juga koordinasi denganKementerian Luar Negeri.PHE's position refers to the results of consultationand coordination with external counsel Allen &Overy, Jamdatun, and also coordination with theMinistry of Foreign Affairs.Pada tanggal 29 April 2024, Victoria Courttelah melakukan hearing pertamabersama para Pihak untuk menentukanjadwal pemeriksaan dan sidang terkaituntuk challenge of service (rogatoryproceeding).On 29 April 2024, the Victorian Court held the firsthearing with the Parties to determine the schedulefor examinations and hearings related to challengeof service (rogatory proceedings).Penyampaian affiidavit dari ahli hukumIndonesia dan affidavit dari Allen OveryLLP terkait Rogatory telah disubmit padatanggal 3 Juni 2024.Submission of an affidavit from an Indonesian legalexpert and an affidavit from Allen Overy LLPregarding Rogatory was submitted on3 June 2024.PHE saat ini sedang mempersiapkantanggapan atas affidavit yangdisampaikan oleh Cooper danselanjutnya tanggapan affidavit tersebutdijadwalkan akan disampaikan kepadaVictoria Court pada tanggal 19 Juli 2024.PHE is currently preparing a response to the affidavitsubmitted by Cooper, and such response isscheduled to be submitted to the Victoria Court onJuly 19, 2024.
