Mitra di KKKS WMOadalah PT Mandiri Madura Barat (PT MMB)dan Kodeco Energy Co Ltd. (Kodeco).Dalam pelaksanaan operasi migas oleh PHEWMO, terdapat klaim dari PT MMB kepadaPHE WMO atas kegiatan Joint Operation(JO ) dan Exclusive Operation (EO) periodetahun 2011 -2019.PHE WMO is the operator that manages theWest Madura Offshore Working Area(WMOPSC). The partners in the WMO PSC arePT Mandiri Madura Barat (PT MMB) and KodecoEnergy Co Ltd. (Kodeco). In conducting theimplementation of oil and gas operations by PHEWMO, there was a claim from PT MMB to PHEWMO for Joint Operation (JO) and ExclusiveOperation (EO) activities for the period 2011-2019.Pada bulan Januari, Februari dan April 2020,MMB mengirimkan 5 surat kepada PHEWMO meminta penyesuaian atas EOsebesar US$124 ribu dan JO sebesarUS$195 ribu. Pada tanggal 15 April 2020,MMB membuat laporan polisiNo. LB/B/0191/IV/2020/BARESKRIM atasdugaan melakukan tindak pidanapemalsuan, penipuan/perbuatan curang,penggelapan, penggelapan dalam jabatandan tindak pidana pencucian uang (LaporanPolisi). Klarifikasi terakhir dengan Bareskrimadalah di bulan November 2020.On January, February, and April 2020, MMBsent 5 letters to PHE WMO, requesting anadjustment for EO of US$124 thousandand JO of US$195 thousand. On April 15, 2020,MMB submitted a police reportNo. LB/B/0191/IV/2020/ BARESKRIM onsuspicion of falsification, fraudulent acts,embezzlement, embezzlement in office, andmoney laundering (Police Report). Sebagai bentuk kehatihatian, PHE WMO telah meminta pendapathukum dari Kejaksaan Agung RepublikIndonesia dengan pokok-pokok pendapatantara lain:- Klaim biaya penyesuaian JO tidak tepatdiajukan kepada PHE WMO.- Karena MMB tidak membiayai kegiatanEO, maka MMB tidak berhakmengajukan klaim penyesuaian biayaEO.- Hak untuk melakukan penyesuaiansudah lewat waktu sebagaimana diaturdalam JOA.The police report is currently underinvestigation. As a form of prudence, PHEWMO has requested a legal opinion from theAttorney General's Office of the Republic ofIndonesia with the main points of opinion,among others:- Claim for JO%u2019s cost adjustment is notappropriate to be submitted to PHE WMO.- Because MMB does not finance the EOactivities, MMB is not entitled to submitclaims for EO%u2019s cost adjustment.- The right to make adjustments has expiredas stipulated in the JOA.Sampai dengan laporan keuangan ini terbit,PHE dan MMB sedang melakukan finalisasitandatangan atas letter of engagementevaluasi bersama atas biaya danpendapatan JO dan EO periode 2011-2019.As of the publication of this financial report,PHE and MMB are currently finalizing thesignature of the letter of engagement, jointevaluation of the costs and revenues of JOand EO for the 2011-2019 period.f. Perjanjian Pengalihan 10% ParticipatingInterest di KBH Blok ONWJf. Agreement to transfer a 10% ParticipatingInterest in ONWJ PSCPada tanggal 19 Desember 2017 PT PHE ONWJdan MUJ ONWJ menandatangi perjanjianpengalihan 10% Participating Interest (%u201cPI%u201d) diKBH Blok ONWJ dari PT PHE ONWJ ke MUJONWJ. Perjanjian tersebut berlaku efektif padatanggal diterimanya persetujuan dari MenteriEnergi dan Sumber Daya Mineral (%u201cESDM%u201d) ataupada tanggal yang ditetapkan oleh MenteriEnergi dan Sumber Daya Mineral dalam suratpersetujuannya.On December 19, 2017, PT PHE ONWJ andMUJ ONWJ entered into an agreement to transfera 10% of PT PHE ONWJ%u2019s participating interest(%u201cPI%u201d) in the ONWJ PSC to MUJ ONWJ.
